This marks a substantial shift in the regulatory attitude towards XRP, especially following its previous designation as a potential security.

XRP Recognized as Eligible Asset in SEC Proposal

The SEC has recently released a notice inviting public feedback on a proposed rule change from the New York Stock Exchange (NYSE). This change would allow cryptocurrency exchange-traded funds (ETFs) to hold a minimum of 80% of their net asset value (NAV) in eligible assets, with XRP being explicitly listed alongside Bitcoin and Ethereum. This step is significant as it aims to facilitate quicker approvals for crypto ETFs under the SEC’s generic listing standard.

The SEC’s approval of the generic listing standard, established last year, has altered the landscape for crypto-related investments. Previously, the SEC under Gary Gensler indicated that only Bitcoin and Ethereum were classified as non-securities, limiting options for potential ETFs. This revised stance highlights XRP’s new status and may provide a framework for enhanced legitimacy and acceptance within the market.

XRP has also gained clarity under current SEC leadership, which, in collaboration with the U.S. Commodity Futures Trading Commission (CFTC), has provided guidance that categorizes XRP, Bitcoin, Ethereum, and several other major cryptocurrencies as commodities. This classification could soon be strengthened by proposed legislation through the CLARITY Act.

The legal clarity achieved for XRP has been crucial, particularly following a notable ruling by Judge Analisa Torres, who determined that XRP is not a security in the ongoing legal battle between the SEC and Ripple Labs. This ruling has empowered the SEC’s ability to approve XRP-related ETFs, effectively preventing the Commission from rejecting applications on the basis that XRP is a security.

Ripple CEO Comments on Regulatory Changes

During a recent appearance at the XRP Las Vegas Conference, Ripple CEO Brad Garlinghouse expressed his appreciation for the SEC’s recent strides towards clearer regulations. He remarked that the current SEC administration, under Paul Atkins, has provided more regulatory clarity in a single year than was achieved during Gary Gensler’s entire tenure.

Garlinghouse reiterated Ripple’s commitment to XRP, emphasizing that they remain the largest holders of the asset and are deeply invested in its success. He addressed criticisms from Cardano founder Charles Hoskinson regarding Ripple’s impact on XRP holders, clarifying that while going public is not an immediate focus for Ripple, they have plans to engage the community meaningfully when the time is right.

As of now, XRP is trading at approximately $1.38, reflecting a positive trend in the past 24 hours, based on data from CoinMarketCap.

In recent developments within the cryptocurrency landscape, the U.S. Securities and Exchange Commission (SEC) has recognized XRP as a legitimate asset, positioning it alongside established cryptocurrencies like Bitcoin and Ethereum.
